One of the most provocative law review articles I've read this year is Choi and
Gulati's A Tournament of Judges, in which they argue that Supreme Court Justices should be chosen purely based on the outcome of an ongoing "tournament" among lower court judges, with the criteria for "winning" a Supreme Court slot being things like citations, reversals by higher courts, etc. Lawrence Solum disagrees strongly in a post well worth reading.
